Legal Question in Criminal Law in California

non practicing lawyer

Hi, I am going through a divorce and my husband's father's friend was once and I believe is no longer a practicing attorney, in what field i do not know. He is my husband's unofficial attorney giving him legal advice and calling me on behalf of my husband. I'm wondering if this guy is allowed to give legal advice if he is not a practicing lawyer or even licensed and how would i find out if he is? i checked a web site and could not find his name.

First call the state bar to make sure you are right. It is unlikely that the police department will get itself involved, Particularly if he is not showing up in court. If he is charging your husband attorney fees he would be the person to file the complaint and we both know he won't .

Ask him to send you a letter of representation. If he won't send you one, or if he says he's not a practicing attorney, then tell him you would rather not deal with him.
