Legal Question in Criminal Law in California

non practicing lawyer giving legal advice

Hi, I am going through a divorce and my husband's father's friend was and I think is no longer a practicing attorney. He is my husband's unofficial lawyer and even calls me to ask questions my husband wants asked. I am wondering if the ''lawyer'' is allowed to give legal advice if he is no longer a practiing lawyer, and how do i find out if he is or not practicing. i searched a site and couldnt find him.

Look for him on the state bar site: http://members.calbar.ca.gov/search/member.aspx

He can likely advise his son all he likes, he just can't be the attorney of record or charge for his services if he is no longer eligible to practice law.
