Legal Question in Criminal Law in California
Notice to appear
My 20 year old son was recently given a Notice to Appear in Santa Barbara, CA. It's marked 25662-minor in pos. of alcohol;and 363- open container of alcohol.
He was not arrested or brought to the station. Do we need a lawyer? We live in San Diego, CA. Can we have the court location changed to here? Is there any way we can have the charges lessoned? My son has never had any other contacts with law enforcement before. We don't know where to start. Any advice would be greatly appreciated.

Your son must appear in person or he can retain a lawyer. Hiring a local attorney in Santa Barbara might be the way to go as there is no way to transfer the case to San Diego. Short of dismissing the case, getting charges reduced to infractions rather than misdemeanors would be a good result it seems.
