Legal Question in Criminal Law in California

first offence,not guilty

my boyfriend was arressted for i think burglery that he didnt do. He has no record at all.This is a weird situation though, you see i became homeless and the house in question is next door and no one lives in it.He and I were in there almost daily to take a shower.About 2 months ago the owner came up and asked my boyfriend if hed seen anyone in the house my boyfriend told him that it was us.They walked through the house and the owner said he wouldnt press charges gave my b.f. his # said if he needed anything to call gave him some food..done.Some other guy comes up a week ago said a boat and etc was gone and they came strait for us.This home is a party haven about once a month, and has been broken into before.Police went through our stuff and found nothing.What do you think we are looking at?chance he will be r.o.ed,?thanks

His chances of OR are slim and none. He doesn't have a permanent address.

Burglary is committed when a person enters a home with the intent to commit a felony or a petty theft. The use of water for a shower could be construed as a theft.

Depending upon the circumstances he may get probation, but there is a high probability that he could be sent to prison.
