Legal Question in Criminal Law in California

open case

my personal items were confiscated (computer, video camera etc. listed as evidence) during a ''volunteer search'', and was charged and then dropped. The case is still open. how long can the case stay open and does the PD have the right to sell my belongings at anytime even though the case is still open/pending?

It's been 6 or so months since the case started and i fear that if I ask for my belongings while the case is open that they'll try to charge me for something.

if they have a charge (assuming its strong evidence) against me, wouldn't they get me asap rather then waiting?

There are Motions that you can file for the return of some (or all) of your items. I'd need more information before I could give you a more definate answer, but I am certain that there is something that can be done.
