Legal Question in Criminal Law in California

outstanding misdemeaner warrant during AWP

In January 2009, I will be serving 14 days work project on 2 misdemeanor charges running concurrent. 2 days ago, I recieved another misd. citation and wont be able to make the court date they gave me, resulting in a warrant. What is the best way to handle this so when I report to AWP I don't have any surprises. ? Since I'm on informal probation, they could make me serve both sentences back to back, I understand. I need this to not happen. please help..

Go in to court at 8 AM sharp and ask them to put up your new case so the arraignment can be "advanced and continued" to a date that is more convenient for you. You appear, there's no warrant.

Hire a lawyer to appear for you in January. A lawyer can appear without a defendant in misdemeanor cases. This is absolutely the best outcome. You want to keep your situation as low key as possible to avoid probation violations. A warrant could really mess things up.

How come you "won't be able to make the court date"? If it conflicts with the work project you (or a lawyer you hire) can ask the court to move the hearing date. The court would probably agree, and the prosecutor would probably stipulate to the change.

If the court date conflicts with something else on your calendar, you should probably keep the court date and change your other plans. If the conflict is with something very important that can't be rescheduled the court might agree to move your hearing date, but you should make your request ASAP.

I strongly recommend hiring a lawyer to help you.
