Legal Question in Criminal Law in California

Parents of minor file a restraining order on older boyfriend. part 2

Can a Parent of a seventeen year old file a Restraining order on her nineteen year old boyfriend simply because they do not like him? The parents think that the two have conducted in sexual acts, but have no evidence to prove it. Even though the boyfriend is older, can the father put a restraining order on him even though he is not threatening or abusive in any way?

The father of the girl has hacked into her email account and her myspace account and her AIM history as well and read all of her emails and messages. The father has proof of fondling but no proof that they have engaged in sex, oral or vaginal. Does this give him ample evidence for a restraining order?

Probably. As guardian ad litum for his daughter, he can bring an action on her behalf to prevent domestic violence. Domestic violence includes rape and sexual abuse.
