Legal Question in Criminal Law in California

Parents of minor file a restraining order on older boyfriend.

Can a Parent of a seventeen year old file a Restraining order on her nineteen year old boyfriend simply because they do not like him? The parents think that the two have conducted in sexual acts, but have no evidence to prove it. Even though the boyfriend is older, can the father put a restraining order on him even though he is not threatening or abusive in any way?

A restraining order is a serious thing. Few judges would impose one in circumstances like these unless there is strong evidence that the relationship is sexual.

Still, the young man should get a lawyer if at all possible to defend him. If he tries to represent himself and fails, the consequences can be quite serious. The restraining order will be on his record and will turn up on background checks by prospective employers, etc.
