Legal Question in Criminal Law in California

parole

Our son was convicted of Captol Murder in Texas under their law of having to serve forty years before becoming eligible for parole. He has over ten years completed and if he is granted an interstate compact to California, just how much time would he have to serve before becoming eligible for parole under California law.

We would so appreciate a reply.

Re: parole

If a Texas court convicted him then his conviction and parole are governed by Texas law. California law cannot change either his sentence or his eligibility for parole.
