Legal Question in Criminal Law in California
My partner was arrested end of last year for domestic violence charges and possible child endangerment. Upon that time we had an argument and he accidentally hit me, which led me to reporting him to the police officials because I was angered of what had happened. When I spoke with an investigator before the case was brought to the DA's attention, I explained the situation of that incident and also thoroughly stated that I would not testify against my partner because he's the father of my children and also I reported the situation to the police out of anger. My partner is currently on bail at the moment, and now I have the DA's investigator harassing my home to serve me papers to go to the hearing charging him.
Of all occasions that the investigator has appeared at my door, I've ignored answering because I refuse to incriminate my partner in a crime that we've both are getting counseling for.
The main question is: Will I be punished although the papers have not yet been served to me? As well, should I be concerned about my partner's case of a possibility of him being found guilty if I do not appear there to be questioned?
