Your question is very difficult to answer. I'm not sure what you mean. However, in many instances, a current charge could be enhanced because of a prior conviction. More information is needed to provide an answer that is going to be useful to you, such as, what and when was your old conviction. What are you being charged with now? Or, what are you concerned about being charged with.
No, just because somebody has a record isn't enough to charge them with a new crime. There must be evidence of some new law violation.
