Legal Question in Criminal Law in California

pc242 assault

my question is this, i was accused of hitting my neigbour by another neighbour. That person called the police, and i was arrested, the person i was supposed to have hit is a close freind who wrote me a letter stating that i never hit him and the other neighbour is nuts. he even went to my court date with me, i spent 4 days in jail because of a neighbour who hates me and told police i hit my other neighbour whom is denying i hit him. im scared, i work in medicine and cannot have this on record for any reason. my pre-trial is 08may 2003, im worried. even though he will tell the court, or the PDEF i didnt hit him.

Re: pc242 assault

Thank you for your posted question.

The facts of your case are strange, but without seeing the version that appears in the police reports and other documents in your case, you may wish to consider fighting this case to trial. Unless you can bring strong enough evidence, in the form of witnesses and documents, to convince the prosecutor to drop the case or file other charges against you, (which it sounds as though you have tried without success), I truly think you may be able to win at trial, all other factors being equal. I don't see how the prosecution is going to have direct evidence at trial that you hit anyone, if both parties are denying you hit them.

I hope that this information helps, but if you have any further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can.
