Legal Question in Criminal Law in California
PC 415 and confused
I am a United States Marine in so cal and was charged with PC 415 along w/ 3 other Marines. 2 were actually guilty and myself and one other Marine were ''Guilty of association'' as told by the deputy. Arraignment is 17 Nov and we are all shipping to new duty stations between 21 Nov and 15 Dec. I will be reporting to IN on 15 Dec. I was curious about the seriousness of this charge and if pretrial diversions were a possiblity. I have a pristine record (military and civilian) other than this. Should I plead guilty for the sake of being able to ship out or fight it. Thanks

If you plead guilty, you will most likely be placed on probation for a period of 1 - 3 years, depending upon the court you're in, the prosecutor, etc. However, if you are on probation, you may have serious problems with the military. I know that the military will not allow you to become active is you are on probation, and if you are already active, probation may cause greater problems. There are many ways to try to avoid a conviction and probation, and you don't necessarily have to be in Los Angeles to obtain some of these benefits. It's too early too tell, however, what needs to be done. I suggest you consult with a lawyer who is experienced in criminal law and has a working knowledge of military law.
