If someone is convicted of misdemeanor disturbing the peace (pc 415) while under a drug diversion program for another charge, will they be kicked out of the prgram? The alleged crime was before the person was put into drug diversion program BUT conviction was while in the program

If the conduct/crime was before diversion then it should be fine because there was no behavior which violated the terms of probation/diversion program. Probation was imposed after the offense took place.
