penal code 243 D

an adult friend is charged with battery with serious injury (on a 17-yr-old). he has no prior felonies or convictions for violent offenses. what kind of plea bargain would be appropriate?

Each crime is always very factually intensive. No lawyer can tell you what is appropriate until they know the case, until that point it is a guess to get your business.

The goal in such cases (where there is no prior criminal record) always is a plea to a misdemeanor with no jail time, short of a situation where there are legal defenses which could result in exoneration or dismissal of the charges.

It is impossible to tell where your friend's situation fits without knowing more facts. I suggest you consult a lawyer for a more detailed discussion. Most lawyers will not charge you for such initial consultation.

Hi, your question lacks a lot of necessary facts along with other information that must be taken into consideration in order to determine the answer to your question. Most attorneys will not give you the type of assessment your asking for. I would suggest you consult with a private attorney in your area. Generally the initial consultation is at no charge or some very minimal amount. You need to find out how badly the 17 yr old was hurt. You were also specific regarding your friend not having any prior felonies or convictions for violent offenses and that makes me think he does have some other types of priors. The attorney will need to know all that information. The attorney will also need to know how this incident occurred. Plus a long list of other things. Do yourself a favor and consultant with an attorney. The cost, if there is one, will be money well spent. If you do not know an attorney in the area, call your local county bar association and ask for a referral. Good luck
