Penal Code 476, is this a misdameanor or felony? If found guilty of this crime what sort of sentencing could the offender be facing?

If it is a misdemeanor the maximum sentence is 12 months county jail. As a felony the maximum is 3 years in state prison. The dividing line is $200 for the amount of the check or checks.
