Re: penalty
You could be convicted of a felony. You could get fines, jail time, probation, a criminal record that will keep you from getting a job, ever, and your kids will be taken away; and all your teeth will fall out. Or you could get some kind of drug program. It depends on many factors including your prior record and whether you have a good lawyer. Even a good lawyer won't keep your teeth from falling out.
Re: penalty
Generally you will be charged with 11377 H.S.,either as a felony or misdemeanor. Your attorney should first try to get the case dismissed or some kind of D.A. Diversion before your attorney explores diversion per p.c.1000. As a former Deputy D.A. And Certified Criminal Law Attorney, that's how my office would handle your case as we have handled 100's just like yours. Contact me with any further questions at www.wallinlaw.com. Thank you.
