Legal Question in Criminal Law in California
Can a person post on Facebook information from what I am assuming was a confidential police report regarding molestation allegations against her daughter that were found not to be credible and never charged? The mother of the child has mental health problems and was also arrested on the same night for being under the influence of methamphetamine. The police report from 2008 came out it in her trial in 2011 and she thought her conviction (even though she is a meth addict) was a ploy between the sheriffs department, her sister and brother in law, (both police officers) and my friend, the alleged perpetrator. After she was convicted, she posted that she was going to uncover the truth and she was going to get everyone back. She wanted to get the police report changed. 4 years after her report and a year after her trial, she emailed the sheriff's department and told them she suspected that my friend was now molesting the new girlfriends daughter. She states on Facebook that she has been harassing and calling everyone and predicted the new girls name.The new little girl was having a lot of problems at the time; her own father had committed suicide over allegations of molestation in the last year. Somehow the old police report has been excluded and new information was now brought in by the girl from 2008. The mother's are allegedly stating that they do not know each other, but were in a heated battled when he first started dating the new one and went back to his old girlfriend for a very short period in 2010. The old girlfriend is Facebook friends (and actual drug buddies) with the new girlfriends brother. The new girlfriend managed her brother's Facebook account while he is in prison. Besides maiming him on Facebook, the old girlfriend also was making statements that she was going to kill my friend and stab him to death. He now has charges against him after the delusional psychopath woman had the sheriff's department go down to the little girls school. The D.A. has only presented Safe Reports and excluded the old police report. They are presenting that these 2 women have had no contact when it's all over Facebook and the new girlfriend has looked at the old girlfriends very public Facebook account. They have also presented that the old girlfriend is not available with other obligations (although they spoke to her but are pretending they have not; it's on Facebook). The old girlfriend has a commitment warrant for her arrest, doesn't work, and apparently spends most of her time obsessively posting on Facebook since the time he left her for this other woman. Isn't there something wrong with this?

Most anything can and is posted on Facebook. If you are asking about libel you will have to ask your question on a civil litigation page.
