Legal Question in Criminal Law in California
If a person promises to kill someone for certain amount, accepts the payment, but does not kill anyone, is it fraud? Yes, I know, the payer could be booked for 2nd degree attempted murder, but what about the fake hitman?
Additional details: payment was untraceable, communications were over encrypted email. Neither party knows anything about the other. Asking from the perspective of the payee.

It is an illegal contract and totally unenforceable . If it it were enforceable think about this by filing the law suit to recover the money you have to admit you were in a murder for hire scheme
