Legal Question in Criminal Law in California

petty theft charges

I am a college student who was arrested for shoplifting $45.00 worth of paint materials at a department store. I work part-time and cannot afford an attorney. Does it make a difference if I get a public defender rather than an attorney when it comes to amount of time I will be put on probation? This is my first time in trouble with the law.

Borrow the money from your mother and maybe you won't get convicted at all. Do you ever want to be employable? If not, go with the public defender.

Public defenders are good lawyers but they are overworked. A private attorney could probably give your case more time and energy than your PD can give it. This won't necessarily affect the outcome of the case, but it could make a huge difference. As Mr. Stone notes, a conviction for even this minor offense can haunt you for years to come. You should hire a private defense attorney if at all possible.

It matters a GREAT DEAL !!! If you are convicted for petty theft your future will change dramatically. Jobs will be hard to get. It may cost a little more now, but the savings to your future are huge. Don't plead to a theft crime without first talking to a criminal law attorney...and preferably a specialist like ourselves.
