Re: petty theft
As a general rule on the first offense for shop lifiting, the sentence is a fine and probation. However, if there is any jail time even credit for time served, an offense occurring after this conviction, can result in the second offense being charged as a felony.
The result could be much different if you took a bag into the store with you and used the bag to attempt to take the merchnadise out of the store.
