petty theft
this is my first offense for petty theft i took 250 worth of things from a sears will i have to do jail time

Chances are you can avoid jail time if you retain a competent and effective lawyer. That said, jail time is not the only thing you should consider. With the help of a good lawyer, you could have the whole case dismissed. You should avoid having a theft related conviction on your record. Such conviction will make getting new jobs difficult for the rest of your life.
