petty theft from open a software box at wal-mart and write down the serial numbe

very stupid of me but i went to wal-mart and open a game box and write down the software serial and left. they caught me for petty theft. i never took the merchadise. am i guilty of petty theft or burgary?

You took the serial number, which may qualify as a theft. Will this serial number work to activate the same program in your possession?
