petty theft with priors
i am taking my case to trial how can i win i didnt steal garment i seriously forgot i had it with me my priors dont help me i know but i live a new life and i wouldnt steal

The mental state/intent is an element of theft-type crimes. However, the circumstantial evidence is probably against you. If you don't have one, you need a lawyer, to examine all possibilities and present your case in the best possible light. You should see if you qualify for the public defender's help.

The best advice I can offer is to get a lawyer. This is a serious charge, and you could easily trip yourself up by arguing about your own state of mind at the time of the incident. There's too much at stake to do this yourself.
