Legal Question in Criminal Law in California
phone call after arrest
I was arrested about 8p.m. and taken to the police station, where I asked the cop if I could make a phone call. He denied my request to make a call and said I had to wait until after I was transferred to the central jail and booked. It took 5 hours for me to finally be transported to the central jail, and it took another three for me to be booked. I finally had access to a phone about 5p.m. the next day (nearly 24 hours later). Did'nt I have a right to make a call within three hours after my arrest? If so, can the cops get away with purposely denying me that right? Or is there something I can do about it?

You could file a complaint against the officer and possibly even sue the law enforcement agency. That said, the fact that you were denied phone calls will not help you in defending your case. Consult a lawyer or two to see who might be right for you.

You have the right to three phone calls immediately upon being arrested. The arresting officer is required to sign a form that you got them. You could file a claim against the agency and sue. More to the point, what are you doing about the criminal charges? Have you consulted a lawyer?
