Legal Question in Criminal Law in California
Plea changing
At my preliminary hearing, my Conflict Council Public Defender informed me of an offer from the D.A. which was if I plead guilty to felony possession of a controlled substance, they would drop the charge of possession of a controlled substance with intent to sell, that would result in felony probation. So my question is this: Since I accepted the offer and entered a plea of guilty to felony possession, and am now awaiting sentencing...is it possible to change my decision and on what grounds would this be possible?

Re: Plea changing
With drawing a guilty plea is not an easy matter. Generally a guilty plea will be withdrawn only if the was a threat to the defendant, the defendant was misinformed by the court or other such cirucmstances. You should ask you attorney about the possibility of withdrawing your guilty plea. He or she is in the best position to advise you.
