Legal Question in Criminal Law in California

If a plea is entered, is that the end of the line?

I am being charged with embezzlment! I went with the public defenders office because of money! They never sat down and gave me options! The attrny took me out in the hall and said you will have to go to jail for 90days because its your first offense...then took me back in the court room and said just say yes to all the questions the judge asks! He said I will have to go to jail for 90days! I cannot go!! Is this the end of the line or can I get a real attny to push for a motion! They didnt even give me an opportunity for my side of the story! i pleaded no contest and sentencing is in 2 weeks! can I stall this to get a real lawyer that will fight to keep me out of jail? Thank you

Long time, no hear.

You can hire a private attorney and try to withdraw your plea, but if you couldn't afford one before sentencing you probably can't afford one now either. Your public defender -- who *is* a "real lawyer", by the way -- is probably your only option.

Whether making such a motion would be helpful is another matter. The advice your P.D. gave you may have been quite wise, especially if the evidence against you is overwhelming.

Not long ago you used to post about various former employers claiming you had stolen from them, and even after hearing only your side of the story I didn't believe you. Spinning such a tale for a judge who has seen the evidence against you would make things worse and not better.

Good luck,
