They don't "file charges" - that is up to the prosecuting agency (typically the District Attorney). They can make a police report and if there is enough evidence, the police will forward the case to the DA's office for review and potential filing of charges.

To answer the question time - the statute of limitations for most felonies is 3 years, but it can be 4 years in some fraud cases and potentially longer depending on the allegations and specific facts & charges.

Your best bet is to sit down with a local criminal defense attorney face to face to discuss this in greater detail. In the mean time, do NOT make any statements to anyone about this without consulting your attorney.

I agree with Mr. Dane. I just want to emphasize that you need to talk to a lawyer immediately. The lawyer may be able to prevent charges being filed. Also I want to emphasize the fact that you must not talk to anyone, and that includes on line, besides a lawyer about the issue. Do not speak to the police, do not speak to friends, do not speak to anyone.
