Legal Question in Criminal Law in California
police did not file a report?
On a misdemeanor charge, I appeared in court after being bailed out a month earlier. I was told the arresting officer had not filed a report yet. I was told he has up to a year to file it.
Does this happen often, or is it rare?

Re: police did not file a report?
There a number of reasons for this to occur. The report may be misplaced. It could lack sufficient information for the district attorney to file a complaint. The police may be doin further investigation. Normally the court gives you another date to appear. If no complaint is filed at that time the case is dismissed. If the charge is a misdemeanor then a dismissal should end it.
