This is a complicated question. You need to sit down with an experienced criminal defense attorney and go over all of the facts including how the officer got the opener and whether a warrant was obtained. If you were charged or of you are about to be charged you should immediately meet with an experienced attorney. Unless you are a member of the Bar with twenty years experience you cannot handle this on your own.
