Legal Question in Criminal Law in California
the police raided my house about a month ago looking for stolen property, they said they were searching our house because my husbands good friend had been arrested for burglary they were watching him and saw that he was here every day so after they raided his house they came here they didnt find anything that was listed on the warrant but they went ahead and took some of my jewelry, coin collections and camera and my kids video games and ipods etc. my husbands friend ended up getting charged wth fleeing from police and borrowing car without permission. I was told I would have to prove that the stuff was mine. Is this true or is there anything I can do

If no-one was arrested from your home as a result of the search and seizure of the items mentioned, you have a couple options. 1) You can call the detective on the case and see if he/she will return the property willingly. If not than you may have to retain an attorney to file a motion with the court to get the items back. I wish you well.................................. David Wallin
You need an attorney. Police do not have authority to seize property not listed in the warrant, unless it is contraband they discovered while legally searching for something that was listed in the warrant.
