Legal Question in Criminal Law in California

Police and State

Mountain View police say I have a misdemeanor warrant since 9/12/2000, I just went through a nation wide search to be a security guard and was cleared. Is the state right or the police?

Re: Police and State

Either could be wrong. That a background check didn't find your warrant carries no legal weight; if a warrant exists and they missed it the warrant is still valid.

I believe your confusing some things. First a search which is conducted on any level state or nation wide can be flawed. I mean just because something was not found does not mean it is not out there. So even though you had what you called a "nation wide" search conducted it does not mean there is not a warrant out there for you. Next, mistakes can be made both ways. The warrant Mountain View P.D. came across may be in error as well. However I would caution you to error on the side of caution. I would suspect from your question that you may think you do have a warrant out there. You should probably hire an attorney and ask them to research the issue for you. Once they get the information they can inform you about your different options.

However, your question does not have enough facts to really provide you with any guidance. Good Luck,

Brian
