Legal Question in Criminal Law in California
Poppy plants
Is it legal for me to grow papaver soniferum (poppy plants) in my yard? I love the flower as they are so beautiful and I want to begin selling the dried arrangements at my store. But I wanted to check first to see if it is legal for me to grow them, before I go through all the trouble. Currently I live in CA, but is it legal to plant these since I know they are coming from the opiud family and people used to plant them for their medicines. Please let me know if just planting and selling the dried flowers in arrangements is legal or not in the United States.

Re: Poppy plants
It is legal to grow papaver somniferum (poppies) as long as you are not cultivating the stuff with the intent to harvest opium. You might find it difficult to obtain seeds, as the DEA has been quietly encouraging seed wholesalers not to market them. To avoid possible hassles with the law, you might want to cultivate a variety of flowers. Growing a large number of poppies could conceivably lead to troubles.
