Legal Question in Criminal Law in California

Posession of cocaine... 1984 health & safety

My husband was charged in 1984 with posession of cocaine, ( health & safety but don't remember the actual charge) He did a ''drug diversion'' but I don't kow what he actually pleaded. This is cause for concern as when he is completing employment applications for City positions he doesn't know what to put when the question is asked, ''Have you ever been convicted of a felony?'' We don't know if it was an actual felony or what, and obviously the DOJ has his fingerprints but we dont know what it is considered. Please advise.

In 1984 the drug diversion worked as follows: The defendant waived time for a speedy trial and was referred to a drug diversion program. Upon completing the drug diversion program the charges were dismissed. Thus there was no conviction.

However, he needs to be sure that he actually participated in drug diversion. If you know the court house in which the case was filed, you can go to the court and check its records or check with the local sheriff's department to determine if there is a record of a conviction.
