Possessing another person's expired ID card

Do I have a legitimate defense if this was just a

random ID I found? It's not fake, but Im charged with

false identificatio

NO.

The ID card in your possession was not yours. If you used this ID for any purpose, you presented yourself as the person whose ID you had. The ID is therfore false as to you, but is valid as to the person for whom it was issued.
