Legal Question in Criminal Law in California
They've taken Possession, turned it into Sales and now they're keeping my money!
They said that they got a tip.But the ONLY ONE that even knew I HAD any personal was a relative of mine! But I never sold to that RAT or anyone else! They had a warrant and searched my house without me even there!I was ''detained'' down the street at gunpoint.Just having cashed my check the night before and gotten money from my room-mate for rent,I had just over $1,000.They saw that and got on the walkie w/the cops
at the house and then told me I was under arrest for
sales of a contrld.substnc. That they were keeping my money! But when I saw the receipt for what they took, there was plastic packaging. They dug my sandwich bags out of the kitchen drawer! And wouldn't you know it?They forgot to list the money!!AND..they won't release a copy of the police rpt. to ME OR MY LAWYER!Now,what's up with that?I can prove over $600.00 with my paycheck stub
but, I'm told that that amount of money makes my case look bad. There was 3-4 different flavors of meth in 3-4 different bags that came to a grand total of under 1oz.altogether. Do I keep my mouth shut and let them keep my money that I worked 80 hours to earn?Or do I point out the dishonesty of the officers? And if
they all deny it? What can I do to prove it? MAJOR DILEMMA--PLEASE HELP!!
1 Answer from Attorneys
Re: They've taken Possession, turned it into Sales and now they're keeping my mo
You have indicated that you have an attorney. He/she should be the person that you seek advise from.
My experience has been that sometimes bad advise from one attorney is better than conflicting advise from a half dozen attorneys that don't know all the facts. So even though you've set forth a lot of facts there may be a number of important details that you've inadvertently left out.
When the case is filed with by the D. A., and you make your first court appearance you'll get a copy of the police report.
Life is like a volleyball game with a net across the center of the floor. Then someone calls it a basket ball game. The net is taken down and the rules are changed. As long as you want to keep meth around you're going to constantly find yourself in trouble. So learn what game your playing and follow the rules. Even if you beat this charge you're going to be constantly under police surveillance. They now consider you to be one of the bad guys.
