Legal Question in Criminal Law in California

Post Ponement of a Case

All right, I've been arrainged, read the charges and have pleaded not Guilty. The DA did file the paper work before the one year requirement. Now, my case has been post-poned 3 times now, because the DA cannot locate the arresting officer's paper work. I went to court on Wednesday, January, 17th, 2007, which is the 3rd time I've appeared and they post-poned the case until February.

What can I do? Can they continue to post-pone the case as they have? What happen with the constitutional rights of a fair and speedy trail?

Re: Post Ponement of a Case

Make sure you do NOT "waive time." Say "I want a speedy trial" each time you appear.

If you have counsel they should have explained to you why the continuance helps you..if you do not have cousel, get a lawyer and demand a speedy trial...Statutory right to a speedy trial is as simple as counting the applicable days for your case.

I beleive that somewhere you must have waived time.
