Legal Question in Criminal Law in California
Prior prison sentences
I discharged from parole and now i've caught a case. the charge is actually a misdeameaner but i'm charged with a felony and with 3 strike allegations on me. i've won one strike hearing and now i've have one pending deicision left. if i'm fouond guilty of this charge can they sentence me to whatever the charge holds plus for each prior prison sentence an additional 1 year added for this. i thought that once you discharge from parole that basically it means that you have nothing pending, you have completed you sentence with the state. is it legal to give me additional time added onto this charge because of prior criminal history record. with this new charge if found guilty i will receive a new cdc number meaning that the old cdc number i had i've completeed everything successfully isn't that true. please advise me right away. i await for the info patiently. thank you

Unfortunately, your completion of parole does not mean you have wiped the slate clean. In any subsequent criminal cases you are subject to all kinds of special allegations and sentence enhancements like, for example, enhancements for prior strikes or prison terms. There might be others depending on your offense.
