Legal Question in Criminal Law in California
From Prison to Work Furlough
My husband is serving a sentence in Chino State Prison (C.I.M.) He spent his first 3 months in Delano State Prison, and was transferred closer to home, to Chino, CA. He was sentenced to 2 years (in a nut shell, he is serving time for neglecting past issues with the court, and is not considered a ''criminal'' so to speak.
He is very anxious to start working again, and is working inside the prison, however would prefer to be in a work furlough program, so he is able to continue in the machining business, and most importantly to support his family. My question is, approximately when would be the closest date for him to get work furlough, and being limited to what he can do from prison, how would he go about applying for this?
Thank you in advance.

Like a lot of professions the practice of law doesn't always equip attorneys to know everything about what takes place after incarceration. This much I do know. In California the inmate serves 50% time figured this way. While in county jail prior to going to prison they get 1/3 credit i.e. two days served they get credit for three days. Once they go out on the chain and when they arrive at prison they serve one day for one day credit until they are finished processing and get a job. At which time they get two days credit for everyday served. I'm not aware of any work furlough program from any prisons in California. Once the prisoner is released on parol they are expected to find work and check in periodically with their parol officer. Because of the different ways of giving them credit (in county jail they get a full days credit if they arrive before midnight) it's difficult to exactly pin point they day of their release. However the prisoner is normally told exactly when he/she'll be released well before that date.
The exact time of the release is important since on holidays and normal work days it is different.
There are some prisoner rights organizations that may have more information about possible work furlough programs. I'd check on that on the Internet. There may be some answers coming in from some attorneys that have more information.
Lots of luck.
Re: From Prison to Work Furlough
It is really hard to say when he may get out because I don't have all of the facts that surround the case. You state that he is serving time for neglecting past issues with the court. What are these issues? These are all things that need to be taken into consideration.
Normally, you will serve anywhere from 1/2-2/3 of the time sentenced. If you would like our assistance is this matter, please contact our office at 310/277-1707.
