Trying to get off probation early for felony D.U.I.
My fiance was arrested for a felony DUI in Sep.1996. He hit a city street sweeper. There were no injuries. This was his first and only offence. He was sentanced to one year in county jail and 5 years probation. He served 8 months in jail and 3 years probation so far. What are his chances of petitioning to get off probation early?

What you are referring to is a modification of the terms of probation. The court has the power to modify the terms of probation. Whether the court will modify the terms of probation depends on the circumstances of the dui, what he has done since the dui etc. He could talk to his probation officer about modifying the terms of probation. If the probation officer recommends the modification.
