Legal Question in Criminal Law in California

Probation Modification

If you had a public defender on your case, and you already signed a deal, is it possible to hire a private attorney and request a probation modification on terms of probation?

Re: Probation Modification

Any case can be reopened to modify aspects to

apply more appropriately to any case. The psychological barrier is the idea of judicial finality.

Judges are not pleased to see old cases come back

when they are overwhelmed by new cases. However,

depending on the particular aspect you need modified

and the reasons it was not addressed appropriately

in the first place, it may be a fairly easy task.

Feel free to send me via email more specific information

concerning the matter and I could advise more

specifically. I have no idea where in California

you are located but could perhaps find local counsel for

you.

Good Luck

Re: Probation Modification

You need to file for a probation modification order

with the court. What I usually do is charge between

$500 and $1000, depending on the complexity of the case

and the location of the court. It is usually a simple

and quick process, assuming the modifications you want

are reasonable.
