Legal Question in Criminal Law in California

Probation question

My son is on probation and we have had to move all alcohol out of the common rooms. I believe the house is subject to search. I have a party planned this weekend where there will be alcohol (my son will NOT be there). I do not want the sheriff coming to our house during the party. Should we ask the prob. officer for permission for the party. Or is it best not to say or ask for anything?

It seems that probation requirement is that your son is not to use alcohol, not that there is to be no alcohol at your house. It seems, therefore, that the Probation Office has no permission to grant as it is OK for you to have alcohol in the first place. I suppose out of abundance of caution you could tell P.O. that you are going to have a party, especially if you already know him/her. Make sure your son is not going anywhere where he needs permission, like out of state.
