Legal Question in Criminal Law in California

probation violation for failure to appear

How can I re-instate to finish my classes for domestic

violence . If I turn myself in, can they give me more time

than I started with? Would a Lawyer be the better route

for a plea without doing time? And can I legally loose

the money and the probation that was put towards the

original sentance?

Thank you

Re: probation violation for failure to appear

Thank you for your inquiry.

No matter what, you want to take care of this without delay. Delay only makes you look irresponsible, which is a key negative factor for you before a judge.

It's up to the judge to do anything from reinstating you on your original terms of probation, to serving up to the maximum jail time and fines for your particular crime, based upon a plea or finding that you violated probation. Reinstatement has to be done through the court, and a lawyer would absolutely help you in this situation, if only to avoid a more serious sentence under the violation of what you've promised the court.

I'm not sure what you mean about losing the money and the probation towards the original sentence, unless you are speaking about bail or money paid to a domestic violence program. Your fines may increase, yes, if you have a probation violation.

I hope that this helps, but if you need more information, have other questions, or feel that you need legal representation, please contact me directly at [email protected]. Im happy to help in any way that I can.
