Legal Question in Criminal Law in California

Probation Violation

I was on house arrest for one county that went past my remand date for another county, and because of this I am being charged with probation violation. I planned on turning my self in as soon as i get this bracelet off my ankle? My question is what is the chances that the da will go through with this charge? and what kind of time could i get?

Re: Probation Violation

A probation violation has to be willful. In other words, you have to intentionally have missed your court date or other obligation. From what you describe, being on house arrest won't do much for you. What you should have done was contact the county that had you on house arrest and let them know of your court date in the other county & gotten permission to go to court that date.

What's done is done. So now what? You need to have your attorney contact the "new" county ASAP to try and recall any warrant and clear this up. The sooner, the better it looks for you. This *may* be able to be explained away without any additional consequences, but you need to act quickly.
