In 1987 I was charge and convicted of a 246pc mistimeaner In 1992 about 50

mistimeaner's were added to the state of Ca. law's for a person not to be able

to perchise or own a gun. In 1990 after I was off probation as per judge.

I perchised a couple of gun's again I tryed to perchise a gun recently and was

turned down by DROS. I called DROS and they told me the 246pc Is life time

brandishment of fire arm's.Is there anything I can do about this? Is this a

violation of my right's? This was a accident and in no way violant. I made a

stupid mistake when I was young And my deal with the judge was not to

posses a fire armfor three year's Thank you

Re: Can this problem be changed

Under Penal Code section 12021, a person convicted of a misdemeanor violation of 246 is prohibited from possessing a firearm for 10 years from the time of the conviction. If the person has had no other charges since the 1987 incident, he may eligible to purchase a firearm. Before doing so, he should confirm this by requesting a Certificate of Eligiblity from the Department of Justice at (916) 227-4731 (firearms information).
