Legal Question in Criminal Law in California
problems as a Minor
When my son was 17, he was
arrested for stealing a car and
bandalism at at school. He was
arrested and served for that and for
doing drugs. He served about two
months in Juvinile Hall. He is a legal
Resident of the U.S.A., and wants to
become a Citizen. Will the fact that
he had these problems with the law
as a minor prohibit him from
becoming a Citizen? Is it true that
since this happened when he was a
minor, its not in his record as an
adult?. Please answer my question!

Re: problems as a Minor
Fortunately, juvenile convictions do not count as convictions for immigration purposes so it does not appear your son has been made deportable or inadmissible. However, he might have problems in getting his citizenship on account of his history of drug use. If he is continuing to use drugs today, and goes in and out of rehab centers, that will create problems no doubt. He might have problems in being able to establish what is called good moral character for the purpose of his citizenship application. If he continues to be an addict, he might even get deported some day.
You need to contact a good immigration lawyer to discuss the details.
