Prop 36 and PC 851.9
I plead no contest to a misdemenor charge for Being Under The Influence of a Controlled Substance and was sentenced under prop 36. I've completed probation and am wondering if I'm now elligible to seal the arrest and court records under the relief of PC 851.9.
Are people sentenced under prop 36 elligible for this relief? I'm pretty sure I got DEJ because of some documents they gave me but I'm not certain.
What are my chances and how does one go about petitioning the court to do this?
