Legal Question in Criminal Law in California

If I was prosecuted by the DA for a crime committed against someone, even when the person in question has dropped charges, and I win. Who can I sue for legal fees? the state? the DA's office?

Edward Hoffman Law Offices of Edward A. Hoffman

Probably no one. Being acquitted of a crime -- or even being found factually innocent, which rarely happens -- does not entitle the defendant to recover his legal fees. Unless you can show that the government knew (or perhaps should have known) you were innocent but pursued you anyway, you will have to absorb the fees yourself.
