Public Defender

My husband has requested a public defender in a case against him, and the court has denied him one. We cannot afford an attorney. What should we do?

Hello, I am sorry to hear about your difficulties. If you have been denied a public defender then you need to find a way to pay for private counsel. It is very important to have legal counsel in criminal matters. Your liberty is at stake. You may have to borrow or sell some assets to cover the cost.

Many counties have a modest means panel or other provision to provide legal services to individuals in your husbands position.

Contact the public defender's office and inquire about a modest means referral. The local bar association may have modest means panel.

You should contact the modest means referal attorney's and attempt to work out a fee agreement. If you are unable to work out a fee agreement with any of the attorneys, take their names with you to court and explain to the judge you could not hire any of these attorneys. The judge should then appoint the public defender to represent you.
