Legal Question in Criminal Law in California
Public Intoxication
I have been detained for public intoxication three times now. The first two times I was just detained overnight and released in the morning without being charged with anything. However, this third time requires me to appear in court and I am being charged with public intoxication. Will those first two times being in the drunk tank without being charged effect what my punishment will be in court?

Prior detentions without citations should not be part of your record and should not affect your current case. However, I would just add that in these increasingly repressive times you just never know for sure . . .
